Holding

The Court granted provisional anticipatory bail to the petitioner subject to conditions and verification of his antecedent.

Summary

Petitioner Chhotu Yadav sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 24 litres of liquor from a sack. He argued he has a clean antecedent, the liquor was recovered from a place not belonging to him, and the only evidence is a confessional statement made by Kaliya Manjhi while in police custody, which lacks evidentiary value. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and a condition that the petitioner surrender within six weeks for verification of his antecedent. The order further stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in view of the alleged offence under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of Kaliya Manjhi recorded in police custody can be the basis for arrest.

counsel for the petitioner, the petitioner above-named, in the event
