Raushan KumarversusThe State of Bihar

Decided

DISPOSED

Holding

Provisional anticipatory bail is granted subject to bond, sureties and verification of antecedents.

Summary

The petitioner, Raushan Kumar, was implicated in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act for the alleged recovery of 18 litres of liquor from a scooty he owned. He argued that he had a clean antecedent, was not in possession of the liquor at the time of seizure, and was unaware that his friend misused his vehicle. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties of the same amount and that the trial court verify his criminal antecedents. If any antecedent is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bihar Prohibition and Excise Act.
  • Whether mere ownership of the vehicle used in the alleged offence justifies arrest.
  • Whether the trial court must verify the petitioner’s criminal antecedents before confirming bail.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

came to be implicated based on the fact that he is owner of the

seized vehicle. It is next submitted that no prudent person would
