Mayank Sarraf LuckyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to a bail bond and sureties, under Section 482(2) of the Criminal Procedure Code.

Summary

The petitioner, Mayank Sarraf Lucky, was implicated in a fraud case involving Rs.10.65 lakh where duplicate gold jewellery were allegedly sold and cheques issued were dishonoured. He was charged under Sections 316(2) and 318(4) of the Bihar Negotiable Instruments Act and Section 138 of the Negotiable Instruments Act. The petitioner contended that he was merely a signatory to an agreement and had no direct involvement in issuing the cheques, asserting his innocence and lack of criminal antecedent. The State opposed his anticipatory bail application, arguing the seriousness of the offences. The High Court, after considering the submissions, granted anticipatory bail conditioned upon a bail bond of Rs.10,000 and two sureties, directing compliance with Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the fraud case
  • Whether the petitioner’s role as a signatory makes him liable to be arrested under the charges
  • Applicability of Section 482(2) of the Criminal Procedure Code in granting anticipatory bail
