Holding
The Court denied anticipatory bail to the petitioner, holding that the nature of the allegations warranted denial of such relief.
Summary
The petitioner, Bittu Kumar, applied for anticipatory bail fearing arrest in a case registered under multiple sections of the B.N.S., 2023, including offences related to fraud, forgery, and intimidation. The allegations state that he, along with co‑accused Madan Chaudhary, attempted to obtain an Aadhaar card using forged documents and provided false information. It is further alleged that when an informant investigated the matter on 31 July 2025, the accused confronted her, abused her, and threatened her. The petitioner argued that the nature of the accusations did not warrant immediate arrest and sought protection under anticipatory bail provisions. The Court examined the seriousness of the offences and the potential for the petitioner to tamper with evidence or influence witnesses. Concluding that the allegations were grave and the risk of interference existed, the Court rejected the petition for anticipatory bail. The order was delivered by Justice Prabhat Kumar Singh on 19 January 2026.
Issues considered
- What is the applicability of anticipatory bail under the B.N.S., 2023 for the offences alleged against the petitioner?
- Whether the seriousness of the alleged fraud and intimidation justifies denial of anticipatory bail?
