Sukhdev ManjhiversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court grants regular bail to the petitioner.

Summary

Sukhdev Manjhi, a 65‑year‑old with no prior criminal record, applied for regular bail in a case (Mufassil P.S. No. 345 of 2025) involving multiple offences under the Bharatiya Nyaya Sanhita. He contended that the FIR was a counter‑blast of an earlier case, that the charge‑sheet did not specifically allege his involvement, and that six co‑accused had already been released on bail. The State opposed, highlighting severe injuries to the informant’s son. The Court, noting the petitioner’s clean antecedent, the completion of investigation against him, and the precedent of bail to co‑accused, ordered his release on bail with a bond of Rs.20,000 and two sureties. The order effectively disposes of the bail application in the petitioner’s favour.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under the Bharatiya Nyaya Sanhita
  • Whether the lack of specific allegation against the petitioner and the grant of bail to co‑accused justify bail

                                3. The main submissions advanced by petitioner’s

counsel are that the present case is counter blast of the case filed

by petitioner’s side which is earlier in time and date bearing

Muffasil P.S. Case No. 343 of 2025 and the FIR has been

registered against 17 named persons, including the petitioner, and

granted bail by a co-ordinate bench of this Court vide order dated

17.11.2025 passed in Cr. Misc. No. 71584/2025. It is further

                       25.09.2025.

                                    4. Learned APP for the State has opposed the prayer of

the petitioner and submits that the informant’s son was brutally

assaulted and on his body, five fracture injuries were found.

                                    5. Considering the above submissions, averments

made in this application and mainly taking into account the

petitioner’s fair and clean antecedent, completion of investigation

against him, coupled with the privilege of bail having been

granted to six co-accused persons by a co-ordinate bench of this

Court, this Court is inclined to release the petitioner on bail.

Accordingly, let the petitioner named-above be released on bail

on furnishing bail bond of Rs. 20,000/- (Rupees Twenty
