DISMISSED

Holding

The bail application was dismissed, and the petitioner was ordered to remain in custody.

Summary

Kundan Kumar was arrested in connection with a gang rape case registered as Dulhin Bazar P.S. Case No. 200 of 2025 and has been in custody since 17 August 2025. He filed an application for bail, invoking Section 70(1) of the Bihar Narcotic Substances Act, 2023, which the prosecution alleged was the basis of the charge. The State opposed the bail, arguing the seriousness of the alleged gang rape. Justice Sandeep Kumar examined the facts and the nature of the offence. Considering the circumstances, the court dismissed the bail application, ordering that the petitioner remain in custody. The decision reflects the court's view that the gravity of the alleged crime outweighs the grounds for bail.
