Patna High Court

Bhulli DeviversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court granted provisional anticipatory bail to the petitioner subject to verification of antecedents and conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Bhulli Devi, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 7 litres of liquor from a jointly owned family house. She argued that she had no conscious possession of the liquor, that the property was a joint family asset, and that she had a clean criminal record. The State opposed her request for anticipatory bail. The High Court considered the lack of direct possession, the joint family ownership, and her clean antecedent, and ordered provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and verification of her antecedents. The order further stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner can be deemed to have possession of the liquor found in a joint family house.
