Holding
The court granted provisional anticipatory bail to the petitioner, subject to bond, sureties and verification of antecedent under Section 482(2) of the BNSS.
Summary
The petitioner, Kanhaiya Paswan, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly possessing 8.1 litres of liquor recovered from his motorcycle. He argued that he had a clean antecedent, was not in actual possession of the liquor, and was unaware that a friend misused his vehicle. The State opposed the bail. The court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 500 with two sureties and subject to verification of the petitioner’s criminal antecedent under Section 482(2) of the BNSS. If any antecedent is found, the bail may be cancelled; otherwise, it will be confirmed.
Issues considered
- Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
- Whether ownership of the vehicle used in the alleged offence suffices to implicate the petitioner.
- Whether provisional anticipatory bail can be conditioned on verification of the petitioner’s criminal antecedent.
