The Court granted bail to the petitioner on condition of a Rs.10,000 bond with two sureties.

Summary

Petitioner Pawan Yadav applied for bail in a criminal case (PS Case No. 645 of 2025) alleging offences under Sections 80(2), 238 and 3(5) of the B.N.S., 2023. The prosecution alleges that the deceased, Rupam Kumari, was subjected to dowry cruelty and was killed by her in‑laws because she opposed her husband’s illicit relationship. The petitioner contended that he is innocent, has no criminal antecedent, is the brother‑in‑law of the deceased, and has been falsely implicated, having been in judicial custody since 27‑08‑2025. The State opposed the bail. After hearing both sides, the Court found the allegations to be general and directed that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the satisfaction of the Chief Judicial Magistrate.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving alleged dowry‑related cruelty and murder under Sections 80(2), 238 and 3(5) of the B.N.S., 2023.
