The Court granted provisional anticipatory bail subject to bail bonds, sureties and verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Pramod Sah, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 30 litres of liquor were recovered from a location not belonging to him and that a hostile chowkidar implicated him. He argued that no liquor was found in his possession, he would cooperate with investigation, and the police were targeting persons with prior cases without proper inquiry. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on furnishing bail bonds of Rs.15,000 with two sureties and subject to verification of the petitioner’s criminal antecedents under Section 482(2) of the B.N.S.S. If more than three prior cases are found, the bail would not be confirmed; if exactly three, it would be confirmed. The order directs the trial court to verify antecedents and act accordingly.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are appropriate for provisional anticipatory bail.
