Patna High Court

Ankit Sharma @ Ankit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

The petitioner, Ankit Sharma, sought anticipatory bail fearing arrest in a case (PS Amarpur Case No. 330 of 2025) involving alleged offences under Sections 310(4), 310(5) and 111 of the Bharatiya Nyaya Sanhita, 2023 and several provisions of the Arms Act. The prosecution alleged that a country‑made pistol and two cartridges were recovered from a co‑accused, but nothing incriminating was found on the petitioner. The petitioner argued he had no connection with the recovered arms, that Section 103 of the BNSS had not been complied with, and that he had a clean antecedent. The State opposed the bail, contending the seriousness of the offences. The Court, after weighing the submissions, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs.10,000 with two sureties, and complies with Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the BNSS, 2023
  • Whether the requirements of Section 103 of the BNSS, 2023 have been satisfied in the present case
  • Whether the petitioner poses a risk of fleeing, tampering with evidence or influencing witnesses
