Patna High Court

Md. Tanveer @ Md. Tanveer AlamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the anticipatory bail application, granting bail subject to conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Md. Tanveer Alam, applied for anticipatory bail after an FIR was lodged alleging his participation in a violent assault on his family, with charges under multiple sections of the B.N.S. He claimed a clean criminal record and asserted that the allegations were false and motivated by a personal dispute with the informant, who also faced a separate case filed by the petitioner. The State opposed the bail, arguing the seriousness of the offences. The Court considered the petitioner's clean antecedent, the possibility of false implication, and the need to prevent undue hardship, and directed that he be released on bail upon surrendering within six weeks, subject to a bail bond of Rs. 10,000 and two sureties, under Section 482(2) of the B.N.S.S. The application for anticipatory bail was therefore allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances alleged
  • Whether the petitioner’s claim of false implication and clean antecedent warrants bail despite serious charges
