The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of her criminal antecedent.
Summary
Tunni Devi applied for anticipatory bail after an FIR was lodged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act alleging possession of six litres of liquor at her residence, which is a joint family property. She argued that she has a clean antecedent, was not arrested at the scene, and that the liquor was not in her conscious possession; the complaint was allegedly motivated by a personal dispute involving the watchman. The State opposed the bail. The High Court, considering these submissions, directed that she be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of her criminal antecedent under Section 482(2) of the B.N.S.S. The order was conditioned that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application for anticipatory bail was allowed.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the B.N.S.S. in view of the allegations under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
- Whether the alleged possession of liquor in a joint family house can be attributed to the petitioner.
- Whether the petitioner’s clean antecedent warrants the grant of anticipatory bail.
