Patna High Court

Seth Yadav @ Arunjay KumarversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The Court granted provisional anticipatory bail subject to bond, sureties, and verification of antecedents, with confirmation contingent on the antecedent check.

Summary

The petitioner, Seth Yadav, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 100 litres of liquor from the foothills of Chalho hill, where no liquor was found in his possession. He argued that the accusation was based on secret information and that the alleged site did not belong to him. The State opposed his request for anticipatory bail. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on a Rs.10,000 bail bond with two sureties and directed verification of the petitioner’s criminal antecedent. It further held that if more than two prior cases are found, the bail would not be confirmed; otherwise, the provisional order would be confirmed. The order was made under Section 482(2) of the relevant procedural law.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the alleged recovery based on secret information justifies denial of bail.
