The court granted provisional anticipatory bail subject to bond, sureties and verification of antecedents.

Summary

The petitioner, Jiwacch Mahto Satyanarayan Mahto, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022, alleging that 355.200 litres of liquor were recovered from a pickup auto and a motorcycle was seized, though he claimed no ownership or possession of the vehicles. He sought anticipatory bail, arguing that the case was based on secret information and that he was not in actual possession of the contraband. The State opposed the bail. The High Court, applying Section 482(2) of the Criminal Procedure Code, granted provisional anticipatory bail conditioned on a Rs.5,000 bond, two sureties of equal amount, and a six‑week surrender period. The court directed the trial court to verify the petitioner’s criminal antecedents, stipulating that if more than one prior case is found, the bail would not be confirmed, whereas if only one antecedent exists, the bail would be confirmed. The order thus provides temporary protection while allowing the trial court to assess the petitioner’s history.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the CrPC in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the petitioner’s prior criminal antecedents should affect the grant or confirmation of anticipatory bail.

                                3. Learned counsel for the petitioner submits that

auto and a motorcycle was also seized. It is next submitted that

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and is not the owner of

any of the seized vehicle and he came to be implicated based on

                                                       2/2

                                  5. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the event

of his arrest or surrender before the learned Court below within a

                                  6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the

event if it is found that petitioner has antecedent of more than one

case, in that event, it would be presumed that petitioner had

concealed his antecedent before this court, as such, the provisional

anticipatory bail order shall not be confirmed but if on verification

it is found that petitioner has antecedent of one case, in that event

the provisional anticipatory bail order shall be confirmed

                     forthwith.
