BAIL GRANTED

Holding

The court granted bail to the petitioner subject to monetary and procedural conditions.

Summary

The petitioner, Radha Sahani, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 260 litres of liquor recovered from plastic gallons. The petitioner claimed innocence, stating no incriminating material was found in his possession and that the recovery was from an open area accessible to all. He had been in custody since 26 September 2025 and possessed three prior criminal antecedents, with the prosecution noting non‑compliance with Section 103 of the BNSS, 2023. The State opposed bail, but the court, considering the circumstances and length of custody, decided to grant bail. The bail was set at Rs.15,000 with two sureties, subject to conditions including family surety and mandatory appearance at trial dates.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act considering the nature of the offence, prior criminal antecedents, and non‑compliance with Section 103 of the BNSS, 2023.
