Pre‑arrest bail was not granted; the petitioner must apply for regular bail before the District Court.
Summary
The petitioner, Ranjan Kumar, applied for pre‑arrest bail fearing arrest in connection with a case registered under Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The High Court examined the quantity of narcotics seized and concluded that the circumstances did not warrant the grant of pre‑arrest bail. Consequently, the Court directed the petitioner to seek regular bail before the concerned District Court. The District Court was instructed to decide the bail application on the same day it is filed, without any prejudice from the High Court’s observations. The application for pre‑arrest bail was therefore rejected.
