Holding

The Court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner’s antecedent under Section 482(2) of the BNSS.

Summary

The petitioner, Mukesh Singh, sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Excise Act alleging recovery of 3,335.4 litres of liquor from a vehicle. He argued that he was not arrested at the spot, had no possession of the liquor, was not the owner of the vehicle, and that the case was based solely on a confessional statement made by another person in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The Court granted provisional anticipatory bail on the condition that the petitioner surrender within six weeks, furnish a bail bond of Rs.5,000 with two sureties, and submit to verification of his criminal antecedent by the trial court. The order was made subject to Section 482(2) of the BNSS, with a provision that the bail may be cancelled if more than one prior case is found. The Court directed that the trial court verify the antecedent and confirm the bail if only one prior case is discovered.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under the Bihar Excise Act.
  • Whether a confessional statement of a third person in police custody can form a basis for arrest and denial of bail.
  • Whether lack of possession of the seized liquor and non‑ownership of the vehicle preclude the grant of anticipatory bail.

                             3. Learned counsel for the petitioner submits that the

an accused is implicated in a case relating to excise, the police

starts implicating mechanically either at the instance of

counsel for the petitioner, the petitioner above-named, in the event

of his arrest or surrender before the learned trial court within a

                   7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioner and in the

event if it is found that petitioner has antecedent of more than one

case then it would be presumed that petitioner, for the purposes of
