The Court granted provisional anticipatory bail to the petitioner, subject to a bail bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Yogendra Kumar, sought anticipatory bail after an FIR was lodged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act alleging recovery of 13.875 litres of liquor from a public area. He contended that he has a clean criminal record, that the liquor was not in his possession, and that the complaint originated from a village chowkidar without any prior notice to the police. The State opposed the bail, arguing the seriousness of the offence. The High Court, considering the petitioner's clean antecedent and lack of direct possession, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and verification of his antecedent under Section 482(2) of the B.N.S.S. The order stipulated that if any prior case is discovered, the bail would be revoked; otherwise, it would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the petitioner's clean antecedent and lack of possession justify the grant of anticipatory bail.
  • Whether the conditions prescribed under Section 482(2) of the B.N.S.S. are applicable.

                                2. Petitioner apprehends his arrest in a case registered

for the offence punishable under Section 30(a) of Bihar

                   Prohibition and Excise (Amendment) Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 13.875 litres of liquor from a bush at village Mahuli

Khel Maidan. It is next submitted that petitioner was not

arrested from the spot, as such, nothing was recovered from his

conscious possession and even alleged recovery is from a place

which does not belong to the petitioner and is accessible to

villagers at large and he came to be implicated at the instance of

he did not inform the police prior to institution of the instant

                       4. Learned A.P.P. opposes the anticipatory bail

          application.

                       5. Considering the submissions made by the learned

counsel for the petitioner, the petitioner, above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

provisional anticipatory bail on his furnishing bail-bond in the

sum of Rs.500/- (Rupees Five Hundred) with two sureties of the

                       6. The application stands allowed.

                       7. It is made clear that the learned trial Court after

accepting the provisional bail bond of the petitioner shall verify

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedent of even one case, then it
