Patna High Court

Janul Ansari @ Md. Jiyaul AnsariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioners are entitled to regular bail and the court ordered their release on bail.

Summary

The petitioners, Janul Ansari and Intaj Ansari, were arrested in connection with a case alleging they assaulted an informant and his relatives. They filed an application for regular bail under several sections of the Bhartiya Nyay Sanhita, 2023, claiming false implication and a lack of criminal antecedent. The prosecution’s FIR was described as general and omnibus, and there was a counter‑case between the parties. The petitioners had been in custody for over four months since 12‑Oct‑2025, and a charge sheet had already been filed. Considering the absence of prior convictions, the filing of the charge sheet, and the prolonged detention, the court ordered bail on a bond of Rs.10,000 with two sureties for each petitioner.

Issues considered

  • Whether the petitioners are entitled to regular bail under sections 126(2), 115(2), 117(2), 118(2), 324(4), 351(2), 352 and 3(5) of the Bhartiya Nyay Sanhita, 2023.
