The court granted bail to the petitioner on the condition of a Rs. 10,000 bond with two sureties.

Summary

The petitioner, Ranjan Kumar Singh, sought bail in a case registered as Jale P.S. Case No. 83 of 2025, alleging offences under Sections 105 and 238 of the B.N.S., 2023 and Section 27 of the Arms Act. The prosecution alleged that during a marriage ceremony the petitioner and others discharged firearms, resulting in the death of a dancer. The petitioner contended that he was falsely implicated, that the FIR did not specifically charge any individual, and that the firing was accidental and intended only for merrymaking. He also highlighted that a co‑accused, Rajan Kumar Singh, had previously been granted bail in a similar case (Cr. Misc. No. 49748 of 2025). After hearing both sides, the court found no indication of intent to kill or risk of absconding and ordered the petitioner to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 105 and 238 of the B.N.S., 2023 and Section 27 of the Arms Act.
  • Whether the FIR specifically implicates the petitioner and establishes a prima facie case.
  • Whether the petitioner poses a flight risk or danger to the public.
