The Court conditionally granted provisional anticipatory bail, subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

Petitioner Karu Yadav sought anticipatory bail fearing arrest in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 2,500 litres of liquor from thirteen motorcycles. He argued that he was not arrested on the spot, had no conscious possession of the liquor, and was not the owner of the seized vehicles, contending that the investigation was based solely on secret information. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS. The order further directed the trial court to verify the petitioner’s criminal antecedent; if more than two prior cases are found, the bail would not be confirmed, otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case involving alleged offences under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedent of two cases affects the grant of anticipatory bail.
  • Whether the conditions prescribed under Section 438(2) of the Criminal Procedure Code and Section 482(2) of the BNSS are applicable.
