Ravi Thakur @ Ravi KumarversusThe State of Bihar

Decided

BAIL GRANTED

Holding

Anticipatory bail was granted as the injury was simple and the petitioners were not deemed a flight risk.

Summary

The petitioners, Ravi Thakur and Jitendra Thakur, sought anticipatory bail fearing arrest in a case (Akbarnagar P.S. Case No. 127 of 2024) involving alleged assault causing simple injury under several sections of the Bharatiya Nyaya Sanhita. The prosecution alleged they participated in the assault, while the petitioners claimed innocence and highlighted the victim's injury as simple and their clean (or minimal) criminal antecedents. The State opposed the bail, but the court noted the injury was simple and the petitioners were not likely to abscond. Accordingly, the court allowed the anticipatory bail application, directing release on bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the BNSS. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC and Section 482 BNSS in a case of simple injury assault.
  • Whether the nature of the injury and the petitioners' criminal antecedents justify denial of bail.
