Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners.

Summary

The petitioners, residents of Ghasipakad, were named in FIR No. 328 of 2025 for alleged assault causing simple injury under several sections of the Bharatiya Nyaya Sanhita. They filed an application for anticipatory bail, claiming they were falsely implicated and that the victim’s injury was minor. The State opposed the bail, arguing the seriousness of the offences. The Court examined the nature of the injury and the petitioners’ criminal antecedents, noting that most had prior records but the alleged harm was simple. Considering these facts, the Court granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, invoking Section 438(2) of the CrPC and Section 482 of the BNSS. The order directed the petitioners to surrender within four weeks.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 438(2) of the CrPC and Section 482 of the BNSS given the nature of the alleged offence
  • Whether the simple nature of the victim’s injury warrants bail despite the petitioners’ criminal antecedents
