Patna High Court

Ravish Tanti @ Manish KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to conditions under Section 438(2) of the Criminal Procedure Code.

Summary

The petitioner, Ravish Tanti, was implicated in a FIR alleging offences under Sections 341, 323, 307, 504, 506 and 34 of the IPC, based on the testimony of an informant who claimed the accused assaulted his younger brother. The petitioner contended that he has a clean antecedent, was falsely implicated, and that the informant was intoxicated and had a personal dispute with his relative, making the FIR a retaliatory complaint. He applied for anticipatory bail, arguing that the FIR does not specifically allege any wrongdoing on his part. The State opposed the bail. The Court, after considering the petitioner's clean record and the circumstances of the FIR, granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and compliance with conditions under Section 438(2) of the Cr.P.C., for a period of six weeks from the order.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Criminal Procedure Code.
  • Whether the FIR specifically implicates the petitioner or constitutes a false or retaliatory complaint.
