Patna High Court

Rakesh Singh @ Amarendra Singh @ Rakesh RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Rakesh Singh, was arrested in connection with a case registered under Sections 127(1), 115(2), 109, 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act for allegedly assaulting a victim. He contended that he was falsely implicated due to a land dispute and had been in custody since 11 July 2025. The State opposed his regular bail application. The Patna High Court, considering the length of custody and the circumstances, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount. The court clarified that its order was limited to bail and did not express any opinion on the merits of the underlying criminal case.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences charged.
  • Whether the period of custody and the circumstances surrounding the case justify the grant of bail.
