BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the conditions imposed under Section 482(2) of the CrPC.

Summary

Radhey Shayam Singh and Sunil Kumar Singh applied for anticipatory bail fearing arrest in a fraud case (PS Case No. 426 of 2024) involving alleged production of fake documents, forged signatures on a non‑judicial stamp and a land dispute. The prosecution alleged that the petitioners, who are agnates of the informant, committed fraud and were obstructing the informant’s farming on his land. The petitioners contended they were innocent, had no criminal antecedent, and a title suit was pending between the parties. The State opposed the bail. After hearing both sides, the Court granted anticipatory bail, directing the petitioners to surrender within four weeks and to furnish a bail bond of Rs.10,000 each with two sureties, subject to conditions under Section 482(2) of the CrPC.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners in the fraud and land‑dispute case
  • Whether the allegations constitute a prima facie case justifying denial of bail
  • Whether conditions under Section 482(2) of the CrPC are applicable
