Patna High Court

Krishna Kanhaiya @ SarkarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail and ordered his release on bail with conditions.

Summary

Krishna Kanhaiya sought bail for offences under Sections 109 read with 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. He was not named in the FIR and had been in custody since 14 September 2025. The allegation against him stemmed solely from the confessional statement of co‑accused Prince Kumar, with no material evidence linking him to the crime. The court noted that the investigation was complete, a charge‑sheet had been filed, and Prince Kumar had already been granted bail. Considering the lack of incriminating evidence and the completed investigation, the court ordered the petitioner’s release on bail with a bond of Rs 10,000 and two sureties, subject to conditions under CrPC 437(3) and BNSS 480(3).

Issues considered

  • Whether the petitioner is entitled to bail despite the allegation based only on a co‑accused's confessional statement
  • Whether the completion of investigation and filing of charge‑sheet preclude the necessity of continued custody
  • Whether the lack of material evidence against the petitioner justifies bail
