Patna High Court

Ravindra Kumar @ Ravindra YadavversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the petitioner’s criminal antecedents and the victim’s statement justified refusal.

Summary

The petitioner, Ravindra Kumar, sought anticipatory bail in a case registered under Sections 307, 302, 34 of the IPC and Section 27 of the Arms Act, alleging that he was falsely implicated in the shooting that killed Virendra Kumar and injured Vijay Yadav. The prosecution relied on the injured victim's recorded statement (fardbeyan) identifying the petitioner and a co‑accused as shooters. The petitioner argued innocence, noting he was not named in the FIR and that the allegations were concocted. The court considered the petitioner’s three prior criminal antecedents and the victim’s statement as material factors. Concluding that the antecedents and the victim’s declaration warranted denial of bail, the court rejected the anticipatory bail application. Consequently, the bail petition was dismissed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the alleged involvement in offences under Sections 307, 302, 34 IPC and 27 Arms Act, his prior criminal antecedents, and the victim’s recorded statement.

                                    3. The allegation against the petitioner is that he,

ulterior motive. The allegation levelled against the petitioner is

totally false and based on concocted facts. Petitioner is not

named in the FIR. Petitioner has three criminal antecedents.

                                         5. Learned APP for the State opposed the prayer for

anticipatory bail by submitting that fardbeyan of injured Vijay

Yadav was recorded by the police in Paras Hospital, Patna, in

which he has stated that the petitioner and one Anuj Yadav fired

                                         6. Considering the antecedents of the petitioner and

as also the fardbeyan of the injured, I am not inclined to enlarge

the petitioner on bail. The prayer for grant of anticipatory bail

on his behalf is hereby rejected.

                                         7. Accordingly, the bail application stands

                         dismissed.

                                                                   (Ajit Kumar, J)
