Patna High Court

Ramnath Sahani @ Ramanath SahaniversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail, subject to bond, sureties, and verification of the petitioner’s antecedent.

Summary

The petitioner, Ramnath Sahani, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for allegedly recovering 300 litres of liquor and 800 litres of semi‑prepared liquor from a river bank. He argued that he was not arrested at the spot, had no conscious possession, and that the alleged recovery occurred on public land, casting doubt on the prosecution's case. The petitioner, who has four prior excise cases, sought anticipatory bail, while the State opposed the relief. The Court, considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.20,000 with two sureties and ordered verification of the petitioner’s criminal antecedent. If more than four prior cases are found, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 of the Cr.P.C. for an offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
