Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a cash bond and conditions of appearance.

Summary

The petitioner, Ajay Raj (also known as Dharmendra Kumar), was arrested in connection with a theft of petrol and cash alleged to have occurred on 25 July 2025, and charged under Sections 309(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. He contended that he has no prior criminal record, was not named in the FIR, and was falsely implicated, with no material recovered from his possession. The State opposed bail, arguing the seriousness of the offence. The High Court, after considering the petitioner’s lack of antecedents, the circumstances of his custody, and the claim of false implication, decided to grant bail. Bail was conditioned on a bond of Rs. 15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s regular appearance before the trial court.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 309(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 given the nature of the alleged offence and the claim of false implication.
