The Court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his criminal antecedent.

Summary

The petitioner, Upendra Chaudhary, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 45 litres of liquor from a public place near a railway crossing. He argued that he was not arrested at the spot, no liquor was found in his possession, and the alleged recovery occurred on public land, raising doubts about the chaukidar’s role in the FIR. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.5,000 bail bond, two sureties, and verification of the petitioner’s criminal antecedent, with the order to be confirmed or cancelled based on that verification. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS. The decision hinges on the lack of direct possession and the public nature of the alleged contraband site.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
