Patna High Court

Reeta SinhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Reeta Sinha was charged with murder of her son, alleged illicit relationship, and possession of arms under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The prosecution’s case relied mainly on a confessional statement of a co‑accused, with no other material linking her to the crime. The petitioner argued innocence, clean antecedents, and that she had been in custody since 11 July 2025. The State opposed bail, contending she maintained regular contact with co‑accused. Considering the nature of the accusation, length of custody, and lack of substantive evidence, the court allowed regular bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted in a murder and arms possession case where the primary evidence is a co‑accused’s confessional statement
  • Whether the petitioner’s alleged contacts with co‑accused preclude bail
