Patna High Court

Pawan Kumar @ PawniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail may be granted in the absence of material linking the accused to the recovered liquor and despite prior antecedents, provided the accused furnishes the prescribed bail bond and complies with the stipulated conditions.

Summary

The petitioner, Pawan Kumar, was arrested in connection with a case alleging possession of 50 litres of liquor recovered from his motorcycle, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed innocence, stating he had no knowledge of the goods and that no incriminating material was found in his conscious possession. The State opposed bail, while the petitioner’s counsel highlighted the lack of on‑spot arrest, the petitioner’s four prior criminal antecedents, and non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Considering the circumstances and the period of custody, the High Court inclined to grant bail, subject to a bond of Rs.15,000 with two sureties and specific conditions regarding appearance and future conduct. The order directed release on bail after framing of charge, if not already done, and stipulated cancellation of bail upon default or repeat offence.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act despite prior criminal antecedents.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
