Patna High Court

Ajeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

Ajeet Kumar was arrested in connection with a case (PS Danapur Case No. 1200 of 2024) involving alleged conspiracy and the shooting of an informant's father, alleged under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The prosecution’s case relied mainly on the confessional statement of co‑accused Kundan Kumar, who had already been granted bail. The petitioner argued that the informant was not an eye‑witness, he had a clean antecedent, and he had been in custody since 12‑12‑2024. The State opposed the bail application. The Court, considering the nature of the accusation, the petitioner’s clean record and the length of custody, allowed the regular bail, directing release on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioner under the circumstances of the case.
  • Whether the confessional statement of a co‑accused suffices to sustain the accusation against the petitioner.
  • Whether the petitioner’s clean antecedent and period of custody justify granting bail.
