Patna High Court

Md. Salauddin @ Md.SlauddinversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

The petitioner, Md. Salauddin, was arrested in connection with the theft of temple statues valued at Rs. 50 lakh, alleged under Sections 303(2) and 334(1) of the Bharatiya Nyaya Sanhita, 2023. He contended that he was falsely implicated, not named in the FIR, and that the case against him was based solely on a co‑accused’s confessional statement, with no stolen articles recovered from his possession and no T.I.P. conducted. The petitioner had been in custody since 14 March 2025 and had no prior criminal record. The State opposed bail, but the Court, considering the lack of direct evidence and the period of custody, decided to grant bail. The order directed the petitioner’s release upon furnishing a bail bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • What is the appropriateness of granting bail to the petitioner under Sections 303(2) and 334(1) of the Bharatiya Nyaya Sanhita, given the evidentiary circumstances?
