Patna High Court

Ankit Pandey @ Ankit Kumar @ Ankit Kumar PandeyversusThe State of Bihar

BAIL GRANTED

Holding

The court granted bail to the petitioner, finding that the circumstances warranted release on bond.

Summary

The petitioner, Ankit Pandey, was arrested in connection with a robbery alleged under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that four unknown assailants robbed an informant of jewellery and a mobile phone. The petitioner contended that he was falsely implicated, not named in the FIR, and no incriminating material or recovered loot was found in his possession; he also had no prior criminal record. The State opposed bail, but the court noted the petitioner had been in custody since 25‑09‑2025 and that a co‑accused had already been granted bail. Considering parity and the length of custody, the court decided to grant bail on the condition of a Rs.15,000 bond with two sureties. The petitioner was ordered to be released on bail.

Issues considered

  • Whether the petitioner is entitled to bail under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023 despite the prosecution’s allegations.
  • Whether the lack of incriminating material, non‑mention in the FIR, and absence of prior criminal record justify granting bail.
