BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to bond and surety conditions.

Summary

Mansukh Yadav sought anticipatory bail fearing arrest in a case (PS No. 193 of 2025) under Section 30(a) of the Bihar Prohibition and Excise Act where 720 litres of liquor were seized from a Scorpio. He contended that he was falsely implicated, not the owner or driver of the vehicle, had no criminal antecedent, and that the investigation failed to comply with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail. The Court noted the lack of a prima facie case against the petitioner and the earlier grant of bail to a co‑accused, and consequently ordered anticipatory bail subject to a bond of Rs.15,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
  • Whether a prima facie case exists against the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the investigation complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023.
