Patna High Court

Bablu SahniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

The petitioner, Bablu Sahni, was arrested for alleged possession of 30 litres of liquor recovered from a plastic box near a riverbank, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he had no knowledge of or involvement with the recovered liquor, that the location was a public open area, and that no incriminating material was found in his possession. The petitioner also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and pointed to his prior criminal antecedent for which he was already on bail. The State opposed the bail application. Considering the facts, the period of custody already served, and the absence of direct evidence linking the petitioner to the liquor, the Court inclined to grant bail, ordering the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in the present circumstances.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, bars the grant of bail.
