Sunita DeviversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the stipulated bond and conditions.

Summary

The petitioner, Sunita Devi, sought anticipatory bail fearing arrest in a case (Nauhatta P.S. Case No. 164 of 2025) involving alleged offences under sections 126(2), 115(2), 117(2), 109(1), 352 and 3(5) of the B.N.S.S. The prosecution alleged that the petitioner, along with others, assaulted the informant's daughters with bricks, causing head injuries. The petitioner argued that the dispute was a land matter, her husband was already in custody and on bail, and she had no criminal antecedent or specific allegation of an overt act. The State opposed the bail. The Court, noting the lack of specific overt act against a woman of clean antecedent, granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, and conditioned it on Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the nature of the allegations and her clean antecedent
