Mukesh GiriversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Mukesh Giri was arrested after 312 litres of liquor were recovered from two motorcycles and was charged under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was not the owner of the motorcycles, no incriminating material was found in his possession, he had no prior criminal record, and the arrest did not comply with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed the bail application. Considering the lack of direct evidence, the petitioner’s clean record, and the period of custody since 25‑10‑2025, the Court decided to grant bail. The bail was conditioned on a bond of Rs.15,000 and two sureties of the same amount. The order was pronounced by Justice Rudra Prakash Mishra.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in the absence of incriminating material and ownership of the seized vehicles.
  • Whether the arrest complied with the procedural requirements of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
