The court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his antecedents.

Summary

The petitioner, Sunil Kumar, sought anticipatory bail fearing arrest in a case registered under Sections 191(2), 190, 115(2), 132 of the Bihar Narcotic Substances Act and Sections 30(a) and 45 of the Bihar Prohibition and Excise (Amendment) Act, 2022. He alleged that liquor and a large sum of money were recovered from a scooter and a house belonging to another person, and that he had no possession, ownership, or relationship with the seized items. The prosecution’s case relied mainly on a confessional statement made by a person in police custody, which the petitioner argued lacked evidentiary value. The court examined the petition and, considering the petitioner’s clean antecedent and lack of direct involvement, granted provisional anticipatory bail subject to a modest bond, two sureties, and verification of his criminal record by the trial court. The order stipulated that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the allegations and the nature of evidence.
  • Whether the confessional statement of a person in police custody can form a basis to deny anticipatory bail.
