The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Kundan Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act concerning the alleged recovery of 100 litres of liquor from a motorcycle. He argued that he had no prior criminal record, was not in possession of the liquor, and was not the owner of the vehicle, and that the informant’s identity was omitted from the FIR, casting doubt on the prosecution’s case. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the petitioner's clean antecedent and lack of direct possession, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 482(2) of the B.N.S.S. The trial court was directed to verify the petitioner’s antecedents and confirm the bail if no prior cases are found, otherwise the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s lack of possession and clean antecedent justify bail despite the seriousness of the alleged offence.
