Patna High Court

Sachin KumarversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail to the petitioner subject to conditions and verification of antecedents.

Summary

The petitioner, Sachin Kumar, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 for allegedly possessing 10.5 litres of liquor recovered from a motorcycle he owned. He argued that he had no prior criminal record, was unaware of his friend’s misuse of the vehicle, and that ownership alone should not justify arrest. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed the trial court to verify the petitioner’s antecedents. The order stipulated that if any prior case is discovered, the bail would be presumed concealed and the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances
  • Whether ownership of the vehicle implicates the petitioner for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022

                                3. Learned counsel for the petitioner submits that
