Holding
Anticipatory bail was granted to petitioner no.1 (Sweta Devi) subject to conditions, but denied to petitioner no.2 (Badal Kumar).
Summary
Sweta Devi and her husband Badal Kumar sought anticipatory bail in a case alleging offences under Sections 77 and 3(5) of the B.N.S.S and Section 67(A) of the Information Technology Act. The informant, who is in a matrimonial and property dispute with Sweta, claimed the petitioners filmed her while bathing to coerce her. Investigation revealed that Badal Kumar had indeed recorded an inappropriate video and sent it to the informant’s husband, who later forwarded it to the informant; no evidence linked Sweta to the act. The court, applying Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S, granted anticipatory bail to Sweta with bail bonds and sureties, but rejected the same relief for Badal Kumar. The investigating officer’s personal appearance was dispensed with, and the matter was remanded to the trial court for further proceedings.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged offences under the B.N.S.S and IT Act.
- Whether there is sufficient prima facie evidence to justify denial of anticipatory bail to the husband who allegedly made and transmitted the inappropriate video.
