The anticipatory bail application is dismissed as there is no apprehension of arrest while the proceedings are stayed.

Summary

The petitioners, Ram Prakash Pandey and Satya Prakash Pandey, feared arrest in connection with Complaint No.6397 of 2023, which alleged offences under Sections 406, 420 of the IPC and Section 138 of the Negotiable Instruments Act. They filed a quashing application (Cr. Misc. No.19860 of 2025) and subsequently sought anticipatory bail. The Patna High Court had earlier stayed further proceedings in the complaint case. Since the stay removed any immediate risk of arrest, the Court dismissed the anticipatory bail application, granting the petitioners liberty to file a fresh bail prayer if the stay is lifted or the quashing application is dismissed.
