Anticipatory bail was granted to the petitioner.
Summary
The petitioner, Ranvir Kumar, was implicated in a criminal case (PS case No.6, 2025) for alleged offences under Sections 126(2), 115(2) and 69 of the Bharatiya Nyaya Sanhita, based on a complaint by Dauli Devi, who claimed that the petitioner had sexually exploited her for three years under the pretext of marriage and later assaulted her. The petitioner contended that the informant was a married woman who, together with her husband, fabricated the complaint to recover a loan of Rs 20,000, and that the relationship was a consensual love affair between adults. The State and the informant opposed the petitioner’s anticipatory bail, arguing the seriousness of the allegations. The court examined the nature of the accusations, the petitioner’s clean antecedent, and the possibility of a false case, and concluded that anticipatory bail could be granted. Accordingly, the court ordered that the petitioner be released on bail upon surrender within eight weeks, subject to a bond of Rs 10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Issues considered
- Whether the petitioner is entitled to anticipatory bail despite allegations under Sections 126(2), 115(2) and 69 of the Bharatiya Nyaya Sanhita
- Whether the allegations constitute a false or fabricated case that warrants denial of bail

CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH
ORAL ORDER
3 24-03-2026 Heard learned counsel for the petitioner, informant
and the State.
2. Petitioner apprehends arrest in a case registered for
the offences punishable under Sections 126(2), 115(2), 69 of the
Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that informant became
friends with this petitioner through Instagram and in course of
time, they became intimate. Informant alleges that on pretext of
marriage, this petitioner sexually exploited her for three years
and when informant pressurized him for marriage, petitioner
assaulted her and ousted her from the house.
4. Learned counsel for the petitioner submits that

petitioner is innocent and has committed no offence. As a matter
of fact, informant is a married lady and has got three children.
Husband of the informant, namely, Pintu Tanti had borrowed Rs.
20,000/- from the petitioner and when he demanded his money
back, this false and concocted case was lodged against him.
Even if the allegations in the F.I.R. are considered to be true,
informant was major when the relationship developed between
the parties and was fully aware of the consequences of such
relationship which continued for more about three years. He
further submits that acts of repeated intimacy and sexual
relationship was consensual in nature and was not established
under any false promise, threat or coercion and such, the same
cannot be said to be induced or involuntary. As a matter of fact,
it is a case of prolonged love affair between two consenting
adults which has been given a colour of forcible sexual
intercourse with oblique purpose and motive. Petitioner claims
clean antecedent.
5. Learned A.P.P. for the State as well as learned
counsel for the informant vehemently opposed the bail
application.
6. Considering the backdrop of the case, nature of
accusation and clean antecedent, this anticipatory bail is allowed

and it is ordered that let the above named petitioner in the event
