Holding

The Court granted provisional anticipatory bail to the petitioner subject to conditions and verification of his antecedents.

Summary

The petitioner, Sanjeet Das, sought anticipatory bail fearing arrest in a case under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 2,517.120 litres of liquor from three vehicles. He argued he had a clean antecedent, was not arrested on the spot, had no conscious possession of the liquor, and was not the owner of the vehicles, claiming the complaint arose solely from the Chawkidar's information. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and a six‑week period for the petitioner to surrender, directing verification of his antecedents under Section 438(2) of the Cr.P.C. The order stipulated that if any prior case is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the Criminal Procedure Code in the context of alleged offences under the Bihar Prohibition and Excise (Amendment) Act, 2022.

it is submitted that if the Chawkidar was aware of the
