Bail is granted to the petitioner subject to a bond of Rs.15,000, two sureties and compliance with the conditions imposed.
Summary
Chhotu Kumar was arrested in connection with the seizure of 290 litres of country‑made liquor from two motorcycles, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was merely a passer‑by, not the owner of the vehicles, and that no incriminating material was found in his possession; he also had no prior criminal record and had been in custody since 21‑Nov‑2025. The State opposed bail, but the Court noted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and the petitioner’s minimal risk of fleeing. Considering these facts and the period of custody already served, the Court decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s appearance at every trial date. Failure to appear on two consecutive dates would permit cancellation of the bail.
Issues considered
- Whether bail can be granted to a person accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants denial of bail.
- Whether the petitioner’s circumstances justify the grant of bail.
