The court ordered provisional anticipatory bail for the petitioner, subject to bond, sureties and verification of his criminal antecedents.

Summary

Sudhakant Chaudhary, the petitioner, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing four litres of liquor recovered from his motorcycle. He argued that he had a clean record, was not in actual possession of the liquor, and was unaware that a person named Satish misused his vehicle. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his criminal antecedents. If any antecedent is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s alleged ownership of the vehicle and lack of actual possession of liquor justify granting bail.

Subjects

  • anticipatory bail
  • Section 30
  • Bihar Prohibition and Excise Act
  • criminal antecedent
  • vehicle ownership
  • bail bond

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

nothing was recovered from his conscious possession and he

came to be implicated based on the fact that he is owner of the

use his own vehicle for committing an occurrence and thus

event of his arrest or surrender before the learned Court below

within a period of six weeks from today, be released on
